আদালত আরও বলেছে যে লিভ-ইন সম্পর্কের জন্য বেশ কয়েকটি শর্ত রয়েছে যা বিবাহের প্রকৃতির সম্পর্ক হিসাবে বিবেচিত হবে এবং সেই ক্ষেত্রে ওই ব্যক্তিকে সাবালক হতে হবে এবং অবশ্যই ১৮ বছরের বেশি বয়সী হতে হবে।
সম্প্রতি এলাহাবাদ হাইকোর্ট তাঁর পর্যবেক্ষণে জানিয়েছে যে একজন নাবালক অর্থাৎ ১৮ বছরের কম বয়সী ব্যক্তি লিভ-ইন সম্পর্কে থাকতে পারে না এবং এটি কেবল অনৈতিক নয়, বেআইনিও । আদালত আরও বলেছে যে লিভ-ইন সম্পর্কের জন্য বেশ কয়েকটি শর্ত রয়েছে যা বিবাহের প্রকৃতির সম্পর্ক হিসাবে বিবেচিত হবে এবং সেই ক্ষেত্রে ওই ব্যক্তিকে সাবালক হতে হবে এবং অবশ্যই ১৮ বছরের বেশি বয়সী হতে হবে।ভারতীয়দের এমনিতেও বিবাহযোগ্য বয়স ২১ বছর।
