‘Unnatural Sex With Wife a Punishable Offence': হিমাচল প্রদেশ হাইকোর্টের যুক্তি খারিজ, স্বামীর বিরুদ্ধে ৩৭৭ ধারায় মামলা করা যাবে না
সম্প্রতি একটি গুরুত্বপূর্ণ আদেশে, হিমাচল প্রদেশ হাইকোর্ট স্বামী-স্ত্রীর মধ্যে আইপিসির ৩৭৭ ধারার অধীনে কোনও অপরাধ দণ্ডনীয় হতে পারে না এমন যুক্তি খারিজ করে দিয়েছে। একটি বেঞ্চ জানিয়েছে যে নভতেজ সিং জোহর বনাম ভারত ইউনিয়ন মামলায় সুপ্রিম কোর্ট কর্তৃক রায়, যা সম্মতিমূলক সমকামী কার্যকলাপকে অপরাধের তালিকা থেকে বাদ দিয়েছে, তা ৩৭৭ ধারা সম্পূর্ণরূপে অসাংবিধানিক করা হয়নি। আদালত জোর দিয়ে বলেছে যে বিবাহের মধ্যে অসম্মতিমূলক বা অস্বাভাবিক যৌন কার্যকলাপ এখনও ধারা ৩৭৭ এর অধীনে অপরাধ হতে পারে এবং নির্দিষ্ট প্রেক্ষাপটে এর প্রযোজ্যতা বজায় রেখেছে।
Himachal Pradesh High Court categorically disagreed with the Uttarakhand High Court’s July 2024 judgment, which held that a husband cannot be prosecuted for unnatural sex with his wife under Section 377 of the IPC.
