বিচারপতি এমআর শাহ ও বিচারপতি সিটি রবিকুমারের বেঞ্চ এই সিদ্ধান্ত দিয়েছে। বেঞ্চ আরও স্পষ্ট করেছে যে বর্তমান স্থগিতাদেশ সেই সমস্ত পদোন্নতির ক্ষেত্রেও প্রযোজ্য হবে যাদের নাম মেধা তালিকায় প্রথম ৬৮ জন প্রার্থীর মধ্যে নেই
শুক্রবার সুপ্রিম কোর্ট ৬৮ জন গুজরাট আদালতের বিচার বিভাগীয় কর্মকর্তার পদোন্নতি স্থগিত করেছে, যার মধ্যে সেই বিচারক আছেন যিনি রাহুল গান্ধীকে মোদী উপাধি মন্তব্য মামলায় দোষী সাব্যস্ত করেছিলেন। উচ্চ আদালত তার পর্যবেক্ষণে বলেন, বর্তমানে পদোন্নতি পাওয়া বিচারকদের তাদের মূল পদে ফেরত পাঠাতে হবে। বিচারক হরিশ ভার্মা, যিনি মানহানির মামলায় রাহুল গান্ধীকে দোষী সাব্যস্ত করেছেন এবং সাজা দিয়েছেন,পদোন্নতি বন্ধ করা সেই বিচারকদের মধ্যে রয়েছেন।
বিচারপতি এমআর শাহ ও বিচারপতি সিটি রবিকুমারের বেঞ্চ এই সিদ্ধান্ত দিয়েছে। বেঞ্চ আরও স্পষ্ট করেছে যে বর্তমান স্থগিতাদেশ সেই সমস্ত পদোন্নতির ক্ষেত্রেও প্রযোজ্য হবে যাদের নাম মেধা তালিকায় প্রথম ৬৮ জন প্রার্থীর মধ্যে নেই।
The Supreme Court on Friday stayed the promotion of 68 judicial officers as District Judges in the State of Gujarat, after taking exception to the State Government notifying the promotions while the legality of the promotions was a sub-judice issue before the Court.
